PHOTOGRAPH RIGHTS AND USAGE
The following information is provided as general policy regarding the rights and usage of photographs produced by The Flying Circus Inc. It should be noted that all rights are negotiable in relation to specific assignments and for a particular client.

RIGHTS

Limited rights - Photographs supplied after editing are granted media rights specified at time of negotiation and paid for at an agreed-upon rate for a particular client. Additional rights are granted for uses at rates negotiated, as they become necessary. Additional photographs from the take are available for stock sales after an agreed-upon length of time.

Unlimited rights - Photographs supplied after editing are granted unlimited media rights for a particular client. Additional photographs from the take are available for stock sales after an agreed upon length of time.

Exclusive rights - All photographs from the take are granted unlimited media rights in either advertising or editorial forms. In addition, no stock sales of the photographs are made. A second possible exclusive agreement is made when it is determined that the photographs have no potential uses as stock. These photographs are granted exclusive rights for that particular client.

USAGE

Advertising - When paying for advertising usage, all lesser uses are generally granted (brochures, point-of-purchase, etc.). Advertising photographs are done at premium fees and seldom on a day rate basis. However, the client has the security of knowing the cost based on rights purchased.

Collateral - When paying for collateral usage all upgraded uses are paid for at additional cost negotiated, as they become necessary. Collateral usage consists of brochures, annual reports, direct mail, and all point-of-sale materials.

In all cases the copyright of the photographs remains the property of The Flying Circus Inc. and the sale or use of images produced for a particular client to another client is prohibited.
